Terms of Service

By accessing or using Cinefile, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. You must be at least 13 years old and legally able to enter this agreement. If you use Cinefile for an organization, you represent that you have authority to bind it.

Cinefile is intended for personal moviegoing archives. It is not a ticket seller, theater, payment processor, admissions credential, or guaranteed replacement for an original ticket.

You are responsible for the accuracy of account information, activity under your account, and the security of each Google or ChatGPT account you use to sign in and any Microsoft account you explicitly connect. Do not share access or attempt to claim another person's archive. Notify us if you suspect unauthorized access.

Third-party identity providers control their own accounts and availability. Losing access to every connected ChatGPT and Google sign-in method may prevent access to Cinefile, so maintain at least one of those sign-in methods and keep an export or backup of important archive data.

You retain ownership of content you submit. You represent that you have the rights and permissions needed to upload, forward, store, and share it. Do not submit another person's private receipt, payment information, identity documents, or confidential material without authorization.

You grant Cinefile a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt for technical display, and transmit your content only as needed to operate, secure, improve, and provide the service and the sharing choices you make. This license ends when the content is deleted from active systems, subject to reasonable backup, legal, and security retention.

Cinefile may use automated systems and third-party AI services to read tickets, identify films, detect sensitive barcodes, and suggest archive details. Results may be incomplete, inaccurate, or outdated. You are responsible for reviewing ticket details before relying on or sharing them. Do not use Cinefile's analysis for admissions, payment, identity verification, legal proof, or other high-stakes decisions.

You may not use Cinefile to break the law; infringe intellectual-property, privacy, publicity, or other rights; upload malware or harmful code; scrape, probe, disrupt, overload, or bypass security; access another person's account or private content; automate abusive requests; impersonate others; harass people; publish dangerous ticket barcodes or credentials; resell the service without permission; or help anyone do those things.

We may investigate suspected abuse and remove content, limit features, suspend accounts, preserve evidence, or report conduct when reasonably necessary to protect Cinefile, its users, or others.

Your archive begins private, but you control features that can publish a profile, expose selected ticket details to friends, or create an unlisted shared-stub link. You are responsible for checking every field before sharing. A recipient can save or redistribute visible content, and revoking a link cannot retrieve copies made outside Cinefile.

Cinefile may remove public content or disable sharing that violates these Terms, creates a security risk, or exposes another person's private information.

Cinefile depends on services and content supplied by others, including identity providers, email routing, hosting, AI analysis, TMDB metadata and images, theaters, ticket sellers, and external links. Their terms and privacy policies apply to your use of their services. Cinefile does not control and is not responsible for third-party availability, accuracy, security, content, or practices. References to companies or products do not imply endorsement.

The Cinefile service, software, design, branding, compilation, and original materials are owned by Cinefile or its licensors and are protected by applicable laws. Except for the limited right to use the service under these Terms, no rights are granted. Do not copy, modify, distribute, sell, lease, reverse engineer, or create derivative services from Cinefile except where the law expressly permits it.

Cinefile may add, change, limit, or discontinue features and may experience interruptions. We may suspend or terminate access when you violate these Terms, create risk, fail to maintain a valid account, or when necessary for legal or operational reasons. Where practical, we will provide notice and a reasonable chance to export personal archive data before a non-urgent discontinuation.

You may stop using Cinefile at any time. Export anything you want to keep and contact brian@cinefile.one to request account deletion.

To the maximum extent permitted by law, Cinefile is provided “as is” and “as available.” Cinefile disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted operation, permanent preservation, perfect security, accurate ticket extraction or metadata, acceptance of any ticket, or that every provider, format, link, or feature will remain available. Keep independent copies of irreplaceable originals and exports of important archive data.

To the maximum extent permitted by law, Cinefile and its owner, contributors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, goodwill, or opportunities, arising from the service. Their total liability for all claims relating to Cinefile will not exceed the greater of US $100 or the amount you paid Cinefile during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cinefile and its owner, contributors, and affiliates from claims, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your content, your public sharing, your misuse of the service, or your violation of these Terms or another person's rights.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules, except where your local law requires otherwise. Before filing a claim, contact brian@cinefile.one and give us 30 days to try to resolve it informally. Except for an eligible small-claims matter, disputes that cannot be resolved informally must be brought in the state or federal courts located in Clark County, Nevada, and each party consents to their jurisdiction and venue.

We may update these Terms as Cinefile changes. We will revise the effective date and may provide additional notice for material changes. Unless the notice says otherwise, updated Terms take effect when posted. If you continue using Cinefile after they take effect, you accept the updated Terms. If you do not agree, stop using the service and export your archive.
